These Terms and Conditions apply to enquiries and services provided by Belsky Diamonds, including diamond cutting, bespoke diamond work, repairs and restoration.
Different terms may be agreed in writing for a particular job. Any such agreement should be read alongside these terms.
2. Enquiries and quotations
Customers may contact us to enquire about diamonds, diamond cutting, repairs, restoration and bespoke services.
Where appropriate, we will provide a quotation describing the proposed work and its price. A quotation is based on the information available at the time and may be subject to inspection of the diamond or item concerned.
The quotation should be agreed before work begins. If inspection reveals an issue that materially changes the work required or its cost, we will discuss this with the customer before proceeding with the additional work.
Unless otherwise agreed in writing, a quotation does not guarantee a particular result where the outcome depends on the individual characteristics or condition of a natural diamond.
3. Orders and payment
Payment arrangements may vary depending on the nature and value of the job.
Our usual process is to provide a quotation before starting work and issue an invoice after the work has been completed. A deposit or another payment arrangement may be agreed for particular jobs.
The applicable price, any deposit and the payment terms will be confirmed for the individual job.
Invoices must be paid in accordance with the payment terms stated on the invoice or otherwise agreed in writing.
If you have a question or concern about an invoice, please contact us promptly so that we can discuss it.
4. Customer-owned diamonds and items
Customers may provide their own diamonds or other items for cutting, repair, restoration or bespoke work.
The customer should ensure that they are entitled to instruct us to carry out the work. We may ask for further information about the item or the requested work where reasonably necessary.
The work we agree to undertake will depend on the nature, condition and characteristics of the item.
Natural diamonds can contain inclusions, internal fractures, tension or other characteristics that may not be visible before work begins. These can affect how a diamond responds to cutting, repair or restoration.
Where we identify a material concern before work begins, we will explain it to the customer where reasonably possible.
5. Risks involved in diamond cutting
Diamond cutting involves specialist work on a natural material. Even where a diamond has been examined and the work is undertaken with reasonable care and skill, its internal characteristics may cause it to chip, fracture or break during the process.
The customer acknowledges that these inherent risks exist and that a particular result cannot always be guaranteed.
Our cutting fee is for the agreed specialist work; it is not a premium paid to insure the diamond for its full market value. Customers are strongly advised to arrange suitable insurance for the full value of their diamond while it is in our care, including during cutting, repair or restoration.
The insurance recommendation does not itself determine or remove any legal responsibility that may apply to us. Nothing in these terms excludes or limits liability or customer rights that cannot lawfully be excluded or limited.
6. Repairs, restoration and bespoke work
The scope of each repair, restoration or bespoke job will be agreed with the customer before work begins.
The time required may depend on the nature of the work, the condition of the item, the availability of materials and any unforeseen issues discovered during the process.
Where a material change to the agreed work or price becomes necessary, we will discuss it with the customer before proceeding with the additional work.
For bespoke work, the customer should check and approve any relevant design, specifications or other details supplied for approval before production proceeds.
7. Timing and completion
Any estimated completion date will be provided in good faith based on the information available when the estimate is given.
Some work may take longer than expected because of the condition of a diamond or item, the complexity of the work or circumstances outside our reasonable control. If a significant delay arises, we will communicate with the customer as appropriate.
Where no completion date has been agreed, work will be completed within a reasonable time, taking account of its nature and complexity and applicable legal obligations.
8. Cancellation and changes to a job
If a customer wishes to cancel a job or change the agreed instructions, they should contact us as soon as possible.
The options available may depend on whether work has started, the nature of the job, any materials or services already committed, and applicable consumer law.
Any charge for work already carried out or costs incurred will be handled in accordance with the agreement and applicable law. We will not rely on a term that removes cancellation or other rights which the customer has under the law.
Some bespoke or personalised work may be subject to different cancellation rules from standard goods or services. The applicable position will depend on the particular agreement and the customer's legal rights.
9. Receiving, returning and transporting customer items
Customers may deliver their diamonds or other items to our Birmingham workshop by prior arrangement, or send them by post or courier.
Customers sending items to us are responsible for arranging suitable packaging and delivery. We strongly recommend using a tracked, insured service appropriate to the full value of the item, and keeping proof of postage.
Arrangements for returning completed work will be agreed with the customer. Items may be collected from the workshop or returned by an agreed postal or courier service.
Customers are strongly advised to ensure that suitable insurance is in place during transit, covering the full value of the diamond or item where available.
Responsibility for loss or damage during transport will depend on the circumstances, the arrangements agreed and applicable law. Nothing in these terms excludes or limits liability where doing so would be unlawful.
10. Complaints and concerns
If you are dissatisfied with our service or have a concern about work carried out, please contact us at info@belskydiamonds.com and explain the issue.
We will review the matter and discuss it with you. Your statutory rights remain unaffected by this process.
11. Liability and statutory rights
We will provide our services in accordance with the agreement and applicable legal requirements.
Nothing in these terms excludes or restricts liability where doing so would be unlawful. In particular, nothing here removes consumer rights relating to the provision of services with reasonable care and skill.
The treatment of damage to customer-owned diamonds must be assessed in light of the agreed work, the circumstances of the damage and the law applicable to the particular contract.
12. Privacy
We handle personal information in accordance with our Privacy Policy, which will be made available through the website once finalised.
13. Governing law
These terms are intended to be governed by the law of England and Wales, subject to any mandatory legal protections that apply to the customer.
Nothing in this section limits any rights a consumer may have under applicable law.
